✦ 1. Agreement to Terms

Welcome to Uncharted Stars. These Terms & Conditions ("Terms") govern your access to and use of our website, online store, and any related services (collectively, the "Services") operated by Uncharted Stars ("we," "us," or "our"), an independent original Lolita fashion brand established in 2010.

By accessing our website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, please do not use our Services.

We reserve the right to amend these Terms at any time. Any changes will take effect immediately upon publication to this page, with the "Last Reviewed" date updated accordingly. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.

✦ 2. Eligibility

Our Services are available to individuals who are at least 18 years of age, or who have the consent of a parent or legal guardian. By using our Services, you represent and warrant that you meet this eligibility requirement.

Uncharted Stars reserves the right to refuse service, terminate accounts, or cancel orders at our discretion, including in cases where we believe that eligibility requirements have not been met or these Terms have been violated.

✦ 3. Products & Orders

All items sold by Uncharted Stars are original designs created by our in-house team. As an independent brand committed to artisanal craftsmanship since 2010, each piece is produced with careful attention to quality and detail.

Product Descriptions

We make every effort to display product colours and details accurately. Slight variations may occur due to screen calibration differences or the handmade nature of certain items.

Order Acceptance

Placing an order constitutes an offer to purchase. Your order is accepted and a contract formed only upon our dispatch of a confirmation email and shipment of the item.

Stock & Availability

All products are subject to availability. In the event an item becomes unavailable after your order is placed, we will notify you promptly and offer a full refund or alternative.

Pre-orders & Made-to-Order

Pre-order and made-to-order items have estimated production timelines stated on the product page. These are estimates and may vary due to handcraft production schedules.

We reserve the right to refuse or cancel any order where we suspect fraudulent activity, pricing errors, or violations of these Terms, with a full refund issued where payment has already been made.

✦ 4. Pricing & Payment

All prices listed on our website are in the currency displayed at checkout and are inclusive of applicable taxes unless otherwise stated. Shipping fees, customs duties, and import taxes are calculated separately and are the responsibility of the customer.

  • Currency: Prices may be displayed in multiple currencies for convenience, but the final charge will be made in the currency confirmed at checkout. Exchange rate fluctuations are not our responsibility.
  • Payment methods: We accept major credit and debit cards, and other payment options as displayed at checkout. All transactions are processed through our secure, PCI-DSS compliant payment gateway.
  • Pricing errors: In the event of a pricing error, we reserve the right to cancel the affected order and offer a full refund or the option to purchase at the correct price.
  • Promotional codes: Discount codes are subject to their individual terms, may not be combined unless expressly stated, and cannot be applied retroactively to completed orders.
Customs & Import Duties
International orders may be subject to customs duties, import taxes, or brokerage fees imposed by the destination country. These charges are outside our control and are the sole responsibility of the customer. We are unable to predict, advise on, or reimburse such charges.

✦ 5. Shipping & Delivery

We ship internationally to most destinations. Estimated delivery timeframes are provided at checkout and are calculated from the date of dispatch, not the date of order. These estimates are provided in good faith but are not guaranteed, as transit times may be affected by factors outside our control including carrier delays, customs clearance, and public holidays.

  • Dispatch timelines: In-stock items are typically dispatched within 3–5 business days. Made-to-order and pre-order items follow the production schedule stated on the product listing.
  • Tracking: A tracking number will be provided via email upon dispatch. It is the customer's responsibility to monitor shipment progress.
  • Undeliverable packages: If a package is returned to us due to an incorrect address, failed delivery attempts, or refusal at customs, re-shipping fees will apply. We are not responsible for losses arising from addresses provided incorrectly by the customer.
  • Risk of loss: The risk of loss and title for items pass to you upon delivery to the carrier. We recommend contacting the carrier directly for packages delayed in transit.

✦ 6. Returns, Exchanges & Refunds

We want you to love every Uncharted Stars piece. If you are not fully satisfied, please review our return conditions below. All return requests must be initiated within 14 days of the delivery date by contacting us at support@unchartedstars.com.

Eligible Returns

Items that are unworn, unwashed, unaltered, and returned in their original packaging with all tags intact within 14 days of delivery.

Non-returnable Items

Made-to-order items, sale items marked final sale, items showing signs of wear or alteration, and items without original packaging or tags.

Refund Processing

Approved refunds are processed to the original payment method within 7–10 business days of our receipt and inspection of the returned item. Original shipping fees are non-refundable.

Defective Items

If you receive an item that is defective or materially different from its description, please contact us within 7 days of delivery with photos. We will offer a replacement, exchange, or full refund.

Return shipping costs are the responsibility of the customer unless the return is due to our error (wrong item shipped, manufacturing defect). We recommend using a tracked shipping service, as we cannot be responsible for returned items lost in transit.

✦ 7. Intellectual Property

All content on the Uncharted Stars website — including but not limited to original garment designs, illustrations, photographs, graphic assets, written copy, brand identity, and the Uncharted Stars name and logo — is the exclusive intellectual property of Uncharted Stars and is protected under applicable copyright, trademark, and design laws.

  • You may not reproduce, copy, distribute, modify, or create derivative works from any of our original designs or website content without our prior written consent.
  • Personal, non-commercial use of product images (e.g., sharing on social media with clear attribution to Uncharted Stars) is permitted provided no alterations are made and the brand is clearly credited.
  • Any unauthorised use of our intellectual property may result in legal action. We take the protection of our original creative work seriously, as it represents over a decade of independent design.
Against Reproduction & Counterfeiting
Uncharted Stars strongly opposes the reproduction, counterfeiting, or unauthorised manufacture of our original designs. If you become aware of any such infringement, we encourage you to report it to us at legal@unchartedstars.com.

✦ 8. User Conduct

When using our Services, you agree to conduct yourself in a manner that is respectful, lawful, and consistent with the spirit of the Uncharted Stars community. You agree not to:

  • Use our website or Services for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorised access to our systems, accounts, or databases.
  • Submit false, misleading, or fraudulent information in any order, form, or communication.
  • Post or transmit harmful, offensive, defamatory, or abusive content through any channel associated with our Services.
  • Use automated tools, bots, or scrapers to extract data from our website without express written permission.
  • Engage in any activity that disrupts, damages, or imposes an unreasonable burden on our infrastructure or Services.

Violation of these conduct standards may result in immediate suspension or permanent termination of your account, cancellation of pending orders, and, where appropriate, referral to relevant authorities.

To the fullest extent permitted by applicable law, Uncharted Stars shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of — or inability to use — our Services, products, or website.

Our total liability to you for any claim arising from these Terms or your use of our Services shall not exceed the total amount paid by you for the specific order giving rise to the claim.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Our Services are provided on an "as is" and "as available" basis. While we make every reasonable effort to ensure the accuracy of information on our website and the quality of our products, we make no representations or warranties of any kind — express or implied — regarding the completeness, accuracy, reliability, or availability of our website or its content.

We do not warrant that our website will be uninterrupted, error-free, or free from viruses or other harmful components. You assume all risk in connection with your use of our Services.

Our website may contain links to third-party websites, social media platforms, or service providers (such as payment gateways and shipping carriers). These links are provided for your convenience only. Uncharted Stars has no control over the content, privacy practices, or terms of such third-party sites and accepts no responsibility for them.

Your interactions with third-party services are governed by those parties' own terms and privacy policies. We encourage you to review them before engaging.

✦ 12. Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable law. Any disputes arising out of or relating to these Terms or your use of our Services shall first be addressed through good-faith negotiation between you and Uncharted Stars.

If a dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts of competent jurisdiction in the territory in which Uncharted Stars is registered. Nothing herein prevents either party from seeking injunctive or other equitable relief where necessary to protect intellectual property or confidential information.

If you are a consumer located in the European Union, you may also refer a dispute to your local consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed entirely, without affecting the validity or enforceability of the remaining provisions.
